Gambling exists in many forms, and while land-based gambling has been regulated in various countries around the world, online gambling regulations were implemented only two decades ago or so.

The truth is, regulators were afraid whether they could manage to take control over the online gambling, since when something is online, it is available all over the world, and all kinds of people can access it, minors included. Moreover, websites can get easily hacked and people’s money seemed utterly unprotected. But with time, countries, where land-based gambling was already well-established, started creating conditions, rules, and requirements that would make the monitoring process easier, and the online gambling experience better and fairer for operators and players.

History of Kahnawake Gaming Commission

As mentioned, Kahnawake, the Indian Territory in Canada, was the first one to start licensing online gambling operators. As such, it used to be quite liberal with the regulations. The online gambling market in Kahnawake was launched on the 8th of July, 1999, when the Kahnawake Gaming Commission enacted its Regulations Concerning Interactive Gaming.

In recent years, though, the Kahnawake Gaming Commission, seeing how other reputed regulators worked, had become more serious about its duties. However, its liberal nature at the beginning cost it many licensees who choose to be licensed by other watchdogs, mainly due to stock-trading reasons or financial stuff. Due to it strengthening the rules for gambling and licensing, and thanks to the lesser fees and tax requirements when compared to other jurisdictions, many casinos still choose Kahnawake Gaming Commission over any other.

Casinos that hold a license by this regulator are reputable casinos since one of the first requirements Kahnawake Gaming Commission has imposed to make regulations more rigorous was the requirement for operators’ sites to be hosted in the data centre managed by Continent & Technologies, Mohawk Internet Technologies, within the Mohawk Territory of Kahnawake.

Types of Permits, Authorizations and Licenses

The Kahnawake Gaming Commission allows applicants to apply for 6 different types of permits, authorisations and licenses:

  • An Interactive Gaming License
  • Key Person Permit
  • Client Provider Authorization
  • Live Dealer Studio Authorization
  • Casino Software Provider Authorizations
  • Inter-Jurisdictional Authorizations

The four last authorizations are only enforceable and valid for so long as the Interactive Gaming License to which it is appended is valid. The holder of the Interactive Gaming License is responsible for the acts or omissions of an Authorised Client provider provided that the license holder was aware or should have reasonably been aware of the act or omission of, and have failed to notify the Commission of the breach or have failed to prevent the breach.

Applying for a Kahnawake Gaming Commission

Whether or not a person or a company is sustainable to hold any of the six licenses, permits or authorisations is decided by the Commission or a Commission-appointed Approved Agent who conducts a thorough investigation. The Approved Agent or the Commission, after the license has been granted, may investigate the license holder at any time if they reasonably suspect the license holder, and they can require information or documentation relevant to the investigation. The person or company must agree and comply with these requirements even before they apply for a license.

To apply for a license, permit or authorization, the applicant must satisfy the Commission’s criteria. In the case of an individual applying for a license, that person needs to be of good character, integrity and honesty. The person must provide the Commission with details about personal, business and professional associations, history of civil litigation, personal and professional preferences, credit history of bankruptcies, history of criminal convictions, education, work history and training.

Finally

In the case of a company or corporation, the applicant needs to have a good business reputation, a sound financial background and current position. Also, the applicant has to have arranged a satisfactory corporate and ownership structure, the appropriate services, resources, technical ability and skills to provide the services authorized by its permit, authorization or license. And finally, the applicant must ensure that each director, key person or shareholder with 10% or more ownership of or controlling interest in the company is a suitable individual.

The Kahnawake Gaming Commission may also consider proof that an applicant has been previously licensed to operate by a comparable jurisdiction as prima facie evidence of its sustainability to offer online gambling activities within the Kahnawake Territory.
