Spain boasts probably the largest gambling market in Europe. This is largely because of the clear and precise gambling laws on national level. The Spanish Regulator (Dirección General de Ordenación del Juego or DGOJ) has a very clear agenda which it implements nationwide and both casino operators and players know where they stand in terms of the law.

DGOJ publishes the details of the registration procedure that online gambling establishments need to complete if they want to offer their clients legal online gambling services. The framework stipulates that online casino operators can apply for a general and singular gambling licenses which covers all gaming, gambling and betting aspects.

Spanish License System

With the 2017 legislature, DGOJ gave aspiring online gambling providers the chance to register their online activities for the third time. This period of registration was open in the time window between December 18, 2017 and December 17, 2018.

During this period operators could apply for both general and singular licenses. These licenses were obviously issued so that gambling operators could offer gambling services to people residing in Spain.

The general and singular licenses enabled betting and gambling providers to offer all forms of online gaming. This included fixed-odds betting, casino games, tote betting, poker, bingo, and different types of media contests. In terms of casino games, all forms of online casino products can be registered. This means that a casino provider could apply for a license to organize slots gambling, as well as roulette, blackjack, baccarat and other types of popular games.

DGOJ’s Three Calls for Registration

Spain is currently very open to online gaming, but that wasn’t the case in the past. In fact, it wasn’t until 2011 that Spain started to legalize online gambling activities in its jurisdiction.

The first time the market opened was in 2011. During that call 93 online gambling companies, betting and contest operators were given licenses.
The second opening came in 2014 and during that period 10 new gambling and 15 new betting operators were allowed to offer their services legally. It was during this second registration window that slots and betting exchanges were also regulated.

The third and final registration window allowed gambling operators a longer registration period and its framework updated the regulation on online gambling activities.

General and Singular Licenses

There is a so called double license system in Spain. This is because operators who want to offer legal online gambling services need to first get a general license and then get a singular license.

General licenses are given for three different segments: other gambling games, betting and contests. These general licenses are given only to operators which applied for a license in the given time period specified by DGOJ’s framework.

Singular licenses correspond to the games that gambling and betting operators want to offer. As the name itself implies, these licenses are more specific and deal with singular betting or gambling activities. These include singular licenses such as the ones for sports betting, poker, slots, roulette, blackjack, baccarat and so on. Unlike general licenses, these can be applied for at anytime during the period for which the operator holds the general license.

3-Step Application Process

There are several tasks which online gambling operators need to perform in their application process for a DGOJ license. These tasks can be divided into three steps.
In the first step, the operator applies for the license. To do this the operator must send DGOJ a comprehensive list of economic, financial, technical and corporate data about its state of operations.

During the second step, Spain’s chief regulatory body, DGOJ, grants the operator the Provisional License. This usually happens within the first three months since the operator applied and never takes more than six months for DGOJ to grant this license. It is important to note, that after the Provisional License has been granted, the operator can launch its business and has 4 months to present the Final Certification Report.

In the third and final step, DGOJ answers to the Final Certification Report by granting the Final License. This happens after a period of maximum 6 months after the Provisional License was given to the operator.
